Terms of Service

3.1 Pricing

The Service is provided at a flat rate of $197 USD per order. Payment is required upfront via Stripe.

3.2 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method provided.

3.3 No Refunds Except as Specified

All sales are final except as explicitly stated in our Delivery Guarantee (Section 4).

4.1 48-Hour Delivery Guarantee

We guarantee delivery of your complete order within 48 hours of order confirmation. If we fail to deliver within this timeframe, you are entitled to a full refund. To request a refund, contact us at hello@briskl.tech with your order details.

4.2 Results Guarantee

If you:

• Send all 100 outreach messages to the provided leads within 30 days of delivery
• Use the exact message templates provided without modification
• Send from a warmed-up email domain (not brand new)
• Perform at least one follow-up message per lead
• Provide proof of sends (screenshots or email service data)

AND you receive fewer than 5 responses total, we will deliver an additional 100 leads with personalized messages at no charge.

To claim this guarantee, contact us at hello@briskl.tech within 35 days of original delivery with the required proof.

5.1 Accurate Information

You must provide accurate and complete information about your ICP. Inaccurate information may result in leads that do not match your needs.

5.2 Compliance with Laws

You agree to use the leads and outreach messages in compliance with all applicable laws, including but not limited to:

• CAN-SPAM Act (US)
• GDPR (EU)
• CASL (Canada)
• Any other anti-spam or data protection laws in your jurisdiction

5.3 Prohibited Uses

You may not use the Service to:

• Send spam or unsolicited bulk emails
• Engage in fraudulent activities
• Violate any person's privacy rights
• Distribute malware or malicious content
• Harass, abuse, or harm others

6.1 Quality of Leads

We will make reasonable efforts to ensure leads match your provided ICP and that contact information is accurate at the time of delivery.

6.2 Personalization

Each lead will receive a unique, personalized outreach message based on publicly available information about their company, role, and industry.

6.3 Data Sources

All leads are researched using publicly available information and legitimate business databases.

7.1 Service Provided "As Is"

The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

7.2 No Guarantee of Results

While we provide a Results Guarantee as outlined in Section 4.2, we do not guarantee that you will close deals, generate revenue, or achieve any specific business outcome from using our leads.

7.3 Maximum Liability

Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid for the Service ($197 USD).

7.4 Third-Party Services

We are not responsible for the actions or failures of third-party services, including but not limited to Stripe (payment processing) or email service providers you use to contact leads.

8.1 Deliverables

Upon full payment, you receive a limited, non-exclusive license to use the leads and outreach messages for your business purposes.

8.2 Restrictions

You may not:

• Resell or redistribute the leads to third parties
• Use the leads for purposes other than legitimate business outreach
• Claim the research methodology or outreach templates as your own intellectual property

8.3 Briskl Property

The Briskl name, logo, and all related trademarks remain the exclusive property of Briskl.

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

12.2 Informal Resolution

Before filing any formal dispute, you agree to contact us at hello@briskl.tech to attempt to resolve the issue informally.

12.3 Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration body in the State of Wyoming, United States.
